DISPOSI«’ES GERAIS

Notas IntrodutÛrias

Nota 1: As RecomendaÁıes sobre Ensaios e CritÈrios incorporadas, por referÍncia, em certas disposiÁıes

deste Regulamento est„o publicadas num manual ‡ parte ñ Recommendations on the Transport of Dangerous

Goods, Manual of Tests and Criteria ñ das NaÁıes Unidas, (ST/SG/AC.10/11 Rev. 3), com o seguinte

conte˙do:

Parte I: Procedimentos de classificaÁ„o, mÈtodos de ensaio e critÈrios relativos aos explosivos

da Classe 1.

Parte II: Procedimentos de classificaÁ„o, mÈtodos de ensaio e critÈrios relativos a subst‚ncias

auto-reagentes da Subclasse 4.1 e a perÛxidos org‚nicos da Subclasse 5.2.

CritÈrios, publicaÁ„o em inglÍs supracitada, se apresentar· traduzido para o portuguÍs.

1.1.1 Escopo e aplicaÁ„o

1.1.1.1 Este Regulamento especifica exigências detalhadas aplicáveis ao transporte terrestre de

produtos perigosos. Exceto se disposto em contrário neste Regulamento, ninguém pode oferecer ou aceitar

produtos perigosos para transporte se tais produtos não estiverem adequadamente classificados, embalados,

marcados, rotulados, sinalizados conforme declaração emitida pelo expedidor, constante na documentação

de transporte e, além disso, nas condições de transporte exigidas por este Regulamento.

1.1.1.2 As expedições com origem ou destino aos portos ou aeroportos, que atendam às exigências

estabelecidas pela Organização Marítima Internacional (OMI) ou pela Organização Internacional de Aviação

Civil (OACI) serão aceitas para transporte terrestre.

1.1.1.3 Este Regulamento não se aplica ao transporte de:

a) Produtos perigosos necessários para a propulsão de meios de transporte ou para a operação de

seus equipamentos especializados durante o transporte (p. ex., unidades de refrigeração), ou

que são exigidos de acordo com regulamentos operacionais (p. ex., extintores de incêndio);

b) Produtos perigosos embalados para venda no varejo, portados por indivíduos para uso próprio.

Nota 1: Algumas provisıes especiais da seÁ„o 3.3.1, do CapÌtulo 3.3, tambÈm, indicam subst‚ncias e artigos

n„o sujeitos a este Regulamento.

1.1.1.4 Exceções relativas a produtos perigosos em quantidades limitadas

1.1.1.4.1 Determinados produtos perigosos em quantidades limitadas são isentos do cumprimento

de certas exigências deste Regulamento, nas condições estabelecidas no Capítulo 3.4.

1.1.1.5 De acordo com a Convenção da União Postal Universal, produtos perigosos como definidos

neste Regulamento, à exceção dos relacionados a seguir, não são admitidos nos correios. As autoridades postais

nacionais devem assegurar o cumprimento das disposições relativas ao transporte de produtos perigosos.

Os produtos perigosos, a seguir podem ser aceitos nos correios, sujeitando-se às disposições das autoridades

postais nacionais:

a) Substâncias infectantes e dióxido de carbono sólido (gelo seco) quando utilizado para refrigerar

substâncias infectantes;

b) Material radioativo em volume exceptivo conformado às exigências de 2.7.9.1 e cuja atividade

não exceda um décimo da relacionada no Quadro 2.7.7.1.2.1.

Para a movimentação internacional pelo correio, aplicam-se as exigências adicionais estabelecidas

pelos Atos da União Postal Universal.

1.1.2 Transporte de material radioativo

1.1.2.1 DisposiÁıes gerais

1.1.2.1.1 As Normas (CNEN-NE-5.01 e normas complementares a esta) da Comissão Nacional de

Energia Nuclear – CNEN, autoridade competente nacional , estabelecem padrões de segurança que proporcionam

nível aceitável de controle dos riscos de radiação, criticalidade e térmicos para pessoas, propriedades

e meio ambiente associados ao transporte de material radioativo que se baseiam nos Regulations for the Safe

Transport of Radioactive Material (TS-R-1 (ST-1 Revisado)), da IAEA, Viena (2000). Material explicativo

sobre a TS-R-1 pode ser encontrado no Advisory Material for the IAEA Regulations for the Safe Transport

of Radioactive Material (Edição de 1996), Safety Standard Series Nº ST-2, IAEA, Viena (a ser publicado).

1.1.2.1.2 O objetivo das Normas – CNEN, quanto ao transporte de materiais radioativos, é estabelecer

requisitos de radioproteção e segurança a fim de garantir um nível adequado de controle da eventual exposição de

pessoas, propriedades e meio ambiente contra a radiação ionizante. Essa proteção é obtida, exigindo-se:

a) Contenção do conteúdo radioativo;

b) Controle de níveis externos de radiação;

c) Prevenção de criticalidade;

d) Prevenção de danos causados por calor.

Essas exigências são satisfeitas, primeiramente, por meio de uma abordagem gradual às limitações

de conteúdo por volume e por unidade de transporte e aos padrões de desempenho aplicados a projetos de

volume em função dos riscos do conteúdo radioativo. Em segundo lugar, elas são satisfeitas pela imposição

de exigências de projeto e manuseio de volumes e de manutenção de embalagens, tendo em conta a natureza

do conteúdo radioativo. Finalmente, elas são satisfeitas pela exigência de controles operacionais e requisitos

administrativos, incluindo, quando apropriado, aprovação das autoridades competentes.

1.1.2.1.3 As Normas CNEN aplicam-se ao transporte de material radioativo por qualquer modalidade

terrestre, aquaviária ou aérea, inclusive o transporte acessório ao uso de material radioativo. Transporte

compreende todas as operações e condições associadas ao movimento de material radioativo; essas operações

e condições complementadas por estas Instruções de transporte terrestre, incluem projeto, fabricação,

manutenção e reparo de embalagens, além de preparação, expedição, carregamento, transporte (armazenagem

em trânsito inclusive), descarregamento e recebimento, no destino final, de cargas de volumes e materiais

radioativos. Nas Normas CNEN, aplica-se uma abordagem gradual aos padrões de desempenho, caracterizada

por três níveis gerais de gravidade:

a) Condições rotineiras de transporte (sem incidentes);

b) Condições normais de transporte (pequenos contratempos);

c) Condições de transporte com acidente.

1.1.2.2 Programa de radioproteÁ„o

1.1.2.2.1 O transporte de material radioativo está sujeito a um programa de proteção radiológica

cujo programa deve consistir em planos sistemáticos destinados a garantir que as medidas de proteção radiológica

sejam levadas em conta e de forma adequada.

1.1.2.2.2 A natureza e a extensão das medidas empregadas no programa devem ser proporcionais à

grandeza e à probabilidade de exposição à radiação. O programa deve incorporar as exigências de 1.1.2.2.3 a

1.1.2.2.5, 7.1.12, 7.1.12.3 e os procedimentos emergenciais aplicáveis. Os documentos do programa devem

ser fornecidos para inspeção pelas autoridades competentes, mediante solicitação.

1.1.2.2.3 Devem ser otimizadas a proteção e a segurança para que a intensidade das doses, o número

de pessoas expostas e a probabilidade de exposição se mantenham em nível tão baixo quanto possível, levando

em conta fatores econômicos e sociais; as doses por indivíduo devem permanecer abaixo dos limites

de dose apropriados. Deve ser adotada abordagem estruturada e sistemática que considere as interfaces entre

transporte e outras atividades.

1.1.2.2.4 Os trabalhadores devem receber treinamento apropriado sobre os riscos de radiação envolvidos

e as precauções a serem observadas, para assegurar que a exposição deles e a de outros que possam

ser afetados, por radiações sejam mantidas dentro de limites seguros.

1.1.2.2.5 No caso de exposição ocupacional em atividades de transporte, quando avaliado que a

dose efetiva tem probabilidade:

a) Reduzida de exceder 1mSv por ano, não é necessário manter rotinas especiais de trabalho, monitoramento

detalhado, programas de avaliação de doses nem registro individual;

b) De situar-se entre 1 e 6mSv por ano, deve ser estabelecido um programa de avaliação de dose

mediante monitoração individual ou monitoração do local de trabalho;

c) De exceder 6mSv por ano, deve ser feito monitoramento individual.

Devem ser mantidos registros adequados do monitoramento do local de trabalho e do monitoramento

individual.

1.1.2.3 Garantia de qualidade

1.1.2.3.1 Devem ser estabelecidos e mantidos programas de Garantia de Qualidade baseados em

normas nacionais, internacionais ou outras aceitas pela autoridade competente, relativamente a projeto, fabricação,

ensaio, documentação, uso, manutenção e inspeção de qualquer material radioativo sob forma especial,

materiais e volumes com material radioativo de baixa dispersão, bem como a operações de transporte

e armazenagem em trânsito, para garantir o cumprimento das disposições pertinentes deste Regulamento. O

fabricante, o expedidor e o usuário devem estar preparados para facilitar a inspeção da autoridade competente

durante a fabricação e o uso e para demonstrar que:

a) Métodos de produção e materiais de fabricação atendem às especificações de projeto aprovadas;

b) Todos os volumes são periodicamente inspecionados e, se necessário, reparados e mantidos em

boas condições, de modo que continuem a cumprir todas as exigências e especificações aplicáveis,

mesmo após o uso repetido.

Quando exigida aprovação da autoridade competente, esta deve levar em conta a adequação do programa

de garantia de qualidade.

1.1.2.4 Arranjo especial

1.1.2.4.1 Arranjo especial significa o conjunto de disposições aprovadas pela autoridade competente,

mediante as quais se possa transportar uma expedição que não satisfaça todas as exigências deste Regulamento

aplicáveis a materiais radioativos.

1.1.2.4.2 Expedições, cuja conformidade a qualquer disposição aplicável à Classe 7 sejam impraticáveis

não devem ser transportadas a não ser com um arranjo especial. Se a autoridade competente estiver

convencida de que a conformidade às disposições da Classe 7 deste Regulamento é impraticável e de que as

exigências de segurança padrões estabelecidas neste Regulamento foram cumpridas por outros meios, ela

pode aprovar operações de transporte especiais para uma única expedição ou para uma série de expedições

programadas.Onível global de segurança no transporte deve ser, no mínimo, equivalente ao que seria obtido

se todas disposições aplicáveis tivessem sido atendidas. Para expedições internacionais desse tipo, exige-se

aprovação multilateral.

1.1.2.5 Material radioativo com outras propriedades perigosas

1.1.2.5.1 Além das propriedades radioativas e físseis, qualquer risco subsidiário do conteúdo de um

volume (p. ex., explosividade, inflamabilidade, piroforicidade, toxicidade química e corrosividade) deve ser

considerado na documentação, no projeto da embalagem, na rotulagem, na marcação, na sinalização, na estiva,

na segregação e no transporte, de modo que se cumpram todas as disposições pertinentes a produtos perigosos

deste Regulamento.

1.2.1 DefiniÁıes

Para os fins deste Regulamento:
